Store Sues Customer
Saks Fifth Avenue Sues Customer Over Mis-Priced Jewelry Sale.

A Saks employee sold a jewelry set for $45,000 less than it should have been sold. The customer asks the price the SA told her $26,000 and the customer bought it, it should have been $71,000. Sak's called the buyer and told her about the mistake, words were exchanged and she said no. So they tried to do an unauthorized charge to her credit card...no good, so know they are suing her.

I'm on the fence on this only because I just had a retailer not budge on a mistake of $40 credit, a credit they would have issue if I had clicked the correct link. I know two wrongs don't make a right, but it bothers me that big retailers, if they don't have to budge won't.

Oooooh...Moral Dilemma. Fun.

Personally I think the store puts on their big boy undies and deals with it. THEY messed up, it's their mistake. The unauthorized charge to her card? Isn't that illegal?? I'd counter sue.

Wow. Well, I understand that Saks is freaking out right about now. I imagine that the employee is no longer employed there. I have a feeling that the courts will find this a huge waste of time. This was sold to the customer at the price quoted to her by someone representing the store. If the mistake was not caught before the transaction was completed then it becomes the store's problem. Just my opinion.

I am in agreement with Heidi and Shannon. The store completed the sale; therefore it's a done deal. Plus, with the unauthorized attempt to charge the customers card, I don't think Saks is going to do very well in court. I'm sure time will tell. :)

Sounds like the department manager will have their head on the chopping board. The stock associate mislabeled the item's tag. Either the tag itself was misprinted or it was even a clerical error within the buyers office.
I would counter sue if I was the customer. Hopefully they still have the reciept and price tag in their possession. Saks was completely wrong on trying to charge $45,000 uauthorized. SHAME ON THEM. Normally, (in lower priced items at least) It's marked as a loss, and they simply are stuck eating it.
